TikTok, the popular short-form video platform, faces the possibility of a ban in the United States within just a few months. For several years, TikTok, along with its Chinese parent company, ByteDance, has been scrutinized by U.S. lawmakers and intelligence agencies due to the app’s connections to China. Government officials have expressed concerns in congressional hearings and legal documents, arguing that TikTok may pose significant national security risks. They fear that the Chinese government could exploit the app to access sensitive information about American users or utilize it as a tool for spreading propaganda.
In April, legislators pushed through a law that mandates ByteDance to either divest the app to a non-Chinese owner or face a complete ban. This law has become a focal point of contention.

However, it is important to note that this ruling is unlikely to be the final determination regarding TikTok’s future in the U.S., nor that of its 170 million American users.
Legal experts anticipate that the Supreme Court will decide whether to take up the case before any potential ban could come into effect by mid-January.

Oral arguments will be presented in the U.S. Court of Appeals for the District of Columbia Circuit. In this court, TikTok, ByteDance, and a coalition of TikTok users have come together to challenge the validity of the law. The legislation stipulates that any legal challenges must be addressed by this particular court, partly due to the judges’ familiarity with national security issues.
