Gemini Data Sues Google: AI Name Conflict
Gemini Data, offering its own artificial intelligence platform, has named its service “Gemini.” However, after Google introduced its Gemini model family in December 2023, it also changed the name of its generative AI service to Gemini in February. This situation seems to conflict with Gemini Data’s brand rights.
It is noteworthy that Google did not conduct sufficient research to determine that Gemini Data was already using this name as an AI brand when making the name change. In the complaint filed in federal court in San Francisco this week, it states, As a sophisticated company, Google undoubtedly conducted a trademark clearance search before publicly rebranding its entire AI product line, and thus was certainly aware of Gemini Data’s registered and exclusive rights to the ‘GEMINI’ mark. The complaint continues, Nevertheless, Google decided to bulldoze ahead without hesitation over Gemini Data’s exclusive rights.
Even Gemini Found Google Unjust
The U.S. Patent and Trademark Office (USPTO) allows similar names for different types of businesses. However, this is valid in cases where the likelihood of consumer confusion is low. Typically, name repetition is not approved within the same industry sector. Interestingly, when asked about this issue regarding Google’s AI service Gemini, Gemini Data was deemed justified. This situation evokes the proverb “Feed the crow and it will peck out your eyes.”
